1. Introduction

These Terms & Conditions (also referred to as the "Terms" or "Terms of Use / EULA") govern your use of the Nonna mobile application (the "Application" or "App"), available on iOS (Apple App Store) and Android (Google Play Store), developed and operated by Abraão Azevedo (the "Service Provider", "we", "us", or "our").

By downloading, installing, or using the Application, you agree to be bound by these Terms. Please read them carefully before using the App. If you do not agree to these Terms, do not download or use the Application.

These Terms serve as the End User License Agreement (EULA) required by Apple for apps distributed on the App Store, and as the Terms of Service required by Google for apps distributed on Google Play, including apps offering in-app purchases and auto-renewable subscriptions.

2. Eligibility

The Application is suitable for users of all ages. Users who are minors (under the applicable age of majority in their jurisdiction) may use the Application, but any purchase of a subscription or in-app content must be made by a parent or legal guardian. By completing a purchase, the parent or legal guardian confirms their authorization and acceptance of these Terms on behalf of the minor.

3. License to Use the Application

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Application on a device that you own or control, solely for your personal, non-commercial purposes.

You may not: (a) copy, modify, or create derivative works of the Application; (b) reverse engineer, decompile, or extract the source code of the Application; (c) sublicense, sell, resell, transfer, or assign the Application to any third party; (d) use the Application in any unlawful manner or in violation of these Terms; or (e) remove or alter any proprietary notices or labels on the Application.

All intellectual property rights in and to the Application — including but not limited to trademarks, copyrights, database rights, and trade secrets — remain the exclusive property of the Service Provider.

The Application is offered as a Freemium service. Certain features of the Application are available at no charge, while additional features and content require a paid subscription ("Premium Features"). The Service Provider reserves the right to change which features are free or paid at any time.

6. Subscriptions and Auto-Renewable Billing

The Application offers optional auto-renewable subscriptions that unlock Premium Features (collectively referred to as "Nonna Plus" or "Premium Subscription"). This section sets out all material terms related to these subscriptions, in accordance with Apple App Store Review Guideline 3.1.2 and Google Play's billing policies.

The Service Provider may, at its discretion, offer a free trial period for subscription plans. The duration and availability of any free trial will be shown in the Application at the time of the offer.

Note: Canceling your subscription through any other method (e.g. deleting the app) does not cancel the subscription or stop renewal charges.

The Service Provider does not control and is not responsible for refund decisions made by Apple or Google.

7. User Data and Security

The Application stores and processes personal data you provide in order to deliver the Service. You are responsible for maintaining the security of your device and your account credentials.

The Service Provider strongly advises against jailbreaking (iOS) or rooting (Android) your device. Such actions remove manufacturer-imposed security restrictions, may expose your device to malware and security vulnerabilities, and may cause the Application to malfunction or cease to work entirely.

8. Third-Party Services

The Application uses third-party services to deliver its functionality. Each of these services operates under its own terms and conditions, which you are also subject to when using the Application:

The Service Provider is not responsible for the content, privacy practices, or terms of any third-party service. The inclusion of these services does not imply endorsement by the Service Provider.

9. Internet Connectivity and Data Charges

Some features of the Application require an active internet connection (Wi-Fi or mobile data). The Service Provider is not responsible if the Application does not function at full capacity due to lack of internet access or because you have exhausted your data allowance.

If you use the Application outside of a Wi-Fi area, your mobile network provider's standard rates apply, including potential roaming data charges if you are outside your home region. By using the Application in such circumstances, you accept responsibility for any resulting charges. If you are not the bill payer for the device, you confirm that you have obtained permission from the bill payer before incurring any charges.

10. Device Responsibility

You are responsible for keeping your device charged and operational. The Service Provider cannot be held responsible if you are unable to access the Service because your device's battery has run out or your device is otherwise unavailable.

11. Disclaimer of Warranties and Limitation of Liability

The Application is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or free of viruses or other harmful components.

While the Service Provider strives to keep the Application updated and accurate, they rely in part on third-party data and cannot guarantee the completeness or accuracy of all information available through the Application. The Service Provider accepts no liability for any direct or indirect loss you experience as a result of relying on the Application's functionality or content.

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).

12. Updates and Termination

The Service Provider may release updates to the Application from time to time. Continued use of the Application after an update is released constitutes your acceptance of any revised Terms. You agree to install updates when offered, as older versions may no longer function correctly.

The Service Provider reserves the right to modify, suspend, or discontinue the Application (or any part thereof) at any time, with or without notice. Upon discontinuation, (a) the rights and licenses granted to you under these Terms will end, and (b) you must cease using the Application and, if applicable, delete it from your device.

The Service Provider also reserves the right to terminate or suspend your access to the Application if you violate these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Brazil, unless applicable consumer protection laws in your jurisdiction provide otherwise.

14. Changes to These Terms

The Service Provider may update these Terms from time to time. When changes are made, the "Last updated" date at the top of this page will be revised. You are advised to review this page periodically. Continued use of the Application after changes become effective constitutes your acceptance of the revised Terms.

For material changes that affect your rights — such as changes to subscription pricing or billing terms — the Service Provider will endeavor to provide prior notice through the Application or by other reasonable means.
